Mumbai court stays proceedings against Mehul Choksi in Rs 22.5 crore bank fraud case

MUMBAI: A special trial court in Mumbai on Wednesday stayed proceedings before a magistrate in a Rs 22.5 crore bank fraud case filed by Industrial Finance Corporation of India (IFCI) Ltd against Gitanjali Gems Ltd (GGL) of which Mehul Choksi was a director. The order came in a revision application filed by one of the co-accused Vipul Chitalia.

The IFCI had filed a complaint with the Central Bureau of Investigation (CBI) Banking Securities Fraud Branch, Mumbai, alleging that Choksi approached IFCI seeking financial assistance of Rs 25 crore, for which he pledged jewels worth double the loan amount after due valuation by government-approved valuers. When GGL started committing defaults in its repayment, the IFCI, in order to realise the security, conducted fresh valuation of the pledged jewels. It showed valuation of the pledged jewels had allegedly dropped by 98%. The IFCI alleged that Choksi colluded with the valuers and got the valuation inflated, further adding that the diamonds pledged were low quality lab-made chemical vapour stones and other inferior coloured stones, not the real ones, thus leading to a wrongful loss of over Rs 22 crore.

The CBI had on April 30, 2022, lodged an FIR on the charges of cheating, criminal conspiracy, forgery and under the Prevention of Corruption Act.

On March 2, 2023, the CBI filed its charge sheet before an additional chief metropolitan magistrate (ACCM) at Esplanade court in Mumbai alleging cheating and criminal conspiracy against eight accused, including GGL and Choksi, on which the ACMM took cognisance.

Chitalia then approached the sessions court with a review plea and his lawyers Vijay Aggarwal and Abhiraj Ray argued that the magistrate had given no reasons but had in a mechanical manner, without explaining the role of the accused taken cognisance of a 11,000 page charge sheet, “at lightning speed”.

The lawyer said mandatory Section 65B certificates to prove authenticity of digital records were not produced raising questions of admissibility of evidence.

The plea was that it was only due to the initiation of insolvency proceeding against GGL, that the brand value had fallen and eventually that of the gems pledged with the IFCI.

The special court noted that the magistrate prima facie appears not to have passed a reasoned order while issuing summons to all eight accused. “Prima facie’’ the magistrates’s order does not reflect that any opinion was formed on the basis of the content of the charge sheet while taking cognisance, said the sessions court in its April 26 order, and thus “in view of this prima facie error” further proceedings before the ACMM Esplanade court are stayed till next date and adjourned matter to July 7.

Dominica Court Extends Stay On Mehul Choksi’s Deportation, Allows Him To Meet Lawyers

NEW DELHI: The Eastern Caribbean Supreme Court (ECSC) on Friday, after taking note of submissions made in the Mehul Choksi‘s hebeas corpus petition, restrained Dominican authorities from removing the fugitive diamantaire from the Commonwealth of Dominica until further hearing in the matter.

The next hearing in the matter is scheduled to take place on June 2.

Justice ME Birnie Stephenson of the ECSC on Friday put an injunction restraining the respondents whether by themselves, servants, agents and/or representatives from removing the applicant from the Commonwealth of Dominica until further.

The Court also allowed Choksi to meet his legal counsel and be transported to a hospital for medical attention and for the administration of a Covid-19 test.

The Court also directed the Dominican authorities to file their affidavits in response to the application.

It also restricted media reporting in the matter. The Court’s orders stated: “There shall be no publication or discussion or notification of the press regarding this matter without leave or permission of the court.”

Julian Prevost, Wayne Norde, Cara Shillingford-Marsh, and Wayne Marsh Attorneys at Law appeared for Choksi and the Attorney General Levy A Peter appeared on behalf of the respondents in the matter.

The legal team of the diamantaire on Thursday filed a habeas corpus petition in Dominica and has also highlighted his deprivation of access to legal assistance there.

Advocate Vijay Aggarwal, Mehul Choksi’s lawyer from India said: “The legal team has filed a habeas corpus petition in Dominica for Mehul Choksi and has also highlighted deprivation of access and constitutional rights to him for legal assistance.”

Habeas Corpus is a writ requiring a person under arrest to be brought before a judge or into court, especially to secure the person’s release unless lawful grounds are shown for their detention.

Earlier Choksi’s lawyer also claimed that “marks of torture” have been reported on Choksi’s body, who had allegedly fled Antigua some days ago and ended up in a neighbouring island country Dominica.

Aggarwal alleged that Choksi was forcefully picked from Antigua and then taken to Dominica.

A massive manhunt was launched after Choksi went missing and an Interpol Yellow Notice was issued by Antigua and Barbuda. He was traced and captured in Dominica.

In an exclusive interview to ANI on Wednesday, Prime Minister of Antigua and Barbuda Gaston Browne had said the fugitive diamantaire, who was found in Dominica, would be repatriated to India and that Indian authorities are in touch with those in Dominica.

Choksi and his nephew Nirav Modi are wanted in India for allegedly siphoning off Rs 13,500 crore of public money from the state-run Punjab National Bank (PNB) using letters of undertaking.

In the latest development, the High Court of Dominica has restrained the removal of fugitive ex-diamantaire Mehul Choksi from the country and set the Habeas Corpus petition to be heard next on June 2. As per WIC news, Mehul Choksi will be taken to Dominica-China Friendship hospital to get tested for COVID and for other medical attention. As per reports, the High Court ordered the parties to hold discussions regarding the secure placement for Mehul Choksi after his COVID test returns and asked the parties to mutually agree and inform the Court as well. Further, the Court allowed Mehul Choksi to meet his legal counsels and directed the respondents to file their affidavits by June 1.

Antigua Police rubbishes Mehul Choksi’s abduction claim

Antigua’s Police Commissioner has slammed fugitive ex-diamantaire Mehul Choksi’s advocate for alleging that he was forcefully abducted, and refuted such reports citing that no such information was received, as per Antiguan media reports. Taking on Mehul Choksi’s counsel over the kidnapping allegation, Antigua Police Commissioner Atlee Rodney said that assertions were being made by the former without any evidence and that even the Dominican Police did not believe the ‘abduction theory’. Revealing that Mehul Choksi used a boat to get to Dominica on May 23, the Antigua Police Commissioner ruled out the involvement of any of his personnel in the matter while speaking to local media in Antigua.

Mehul Choksi’s lawyer claims he was tortured

Speaking exclusively to Republic TV, advocate Vijay Aggarwal claimed that the truth regarding the torture faced by his client Mehul Choksi will be out in the next 12 hours. Aggarwal mentioned, “He reached Dominica on Sunday. On Monday, he was taken to the police station. And the news was broken to the world on Wednesday. Because of the court proceedings, now Dominica can’t take them wherever they want and the truth has a very strange way of coming out of the closet”. Earlier, the Eastern Caribbean Supreme Court had temporarily stayed the repatriation of the fugitive diamantaire and allowed him access to lawyers.

The PNB scam accused’s lawyer stated, “The court has also ordered that Mehul Choksi’s affidavit should be put on record. I told you previously that lawyer had just two-minute access to Mr.Choksi in which he narrated his horrifying tale. I will be getting all this and in the next 24 hours, we will get to know all the details. I will get access to Mr.Choksi’s affidavit also.

Indian High Commissioner to visit Dominica seeking Mehul Choksi’s extradition

The government of Dominica on Thursday confirmed that its law enforcement personnel had detained fugitive ex-diamantaire, Mehul Choksi, upon his illegal entry into the country, and then, India confirmed it is sending its High-Commissioner based in Trinidad & Tobago to Dominica on June 3 to seek his extradition. Issuing a statement on Thursday, the Dominican govt said that a red alert notice has been issued for Mehul Choksi by Interpol and that their Ministry of National Security & Home Affairs was in touch with the Antiguan authorities to ascertain facts about Choksi’s citizenship. The statement noted that Mehul Choksi would be repatriated to Antigua after they received information that they have sought. Arun Kumar Sahu, High Commissioner of India based in Trinidad and Tobago will travel to Dominica and a meeting between the Governments of Dominica and India would most likely be held on coming Thursday. All matters related to Indians in Dominica are subject to the High Commissioner of India based in Port of Spain, Trinidad.

Earlier on Thursday, sources informed that the Indian government is in touch with both Antigua & Barbuda and the Dominican government over the matter. This comes after the Prime Minister of Antigua & Barbuda, Gaston Browne, told Republic that he had asked Dominica to deport Choksi directly back to India as a persona-non-grata.

Fugitive Diamantaire Mehul Choksi Missing In Antigua, Says Lawyer: Report

For the first time, Choksi’s counsel advocate Vijay Aggarwal, confirmed that he is missing in the island nation.

New Delhi: 

Fugitive diamantaire Mehul Choksi, who is wanted by the Central Bureau of Investigation (CBI) and Enforcement Directorate (ED), has gone missing in Antigua and Barbuda.

For the first time, Choksi’s counsel advocate Vijay Aggarwal, confirmed that he is missing in the island nation.

In an exclusive statement to ANI, his lawyer said, “Mr Mehul Choksi is missing. His family members are worried and anxious and had called me to discuss. Antigua police is investigating. Family is in the dark and worried about his safety.”

There were media reports in Antigua that the police have launched a manhunt for Mehul Choksi. It was reported that Choksi left his home last evening to go for dinner at a well-known restaurant in the southern part of the island and was never seen again. His vehicle was discovered in Jolly Harbour later in the evening, but no sign of him, reported Antiguan newsroom.

Choksi has been involved in a legal battle to stop his extradition back to India to answer fraud charges against him. Police are yet to issue a statement on the matter, reported Antiguan newsroom.

Earlier, on the media reports regarding his citizenship revocation issue, advocate Vijay Aggarwal had citizenship by an Antiguan civil court, his Advocate Vijay Aggarwal had clarified that “My client Mehul Choksi has clarified that he is very much an Antiguan citizen. His citizenship has not been revoked.”

Earlier, Antiguan Prime Minister Gaston Browne had said, the citizenship of fugitive diamantaire Mehul Choksi, an accused in the multi-crore Punjab National Bank scam, will be revoked and he will be extradited to India once all his legal options are exhausted.

Choksi, 61-year-old is an Indian-born businessman, residing in Antigua and Barbuda and wanted by the Central Bureau of Investigation (CBI) and Enforcement Directorate (ED).

Earlier, Choksi in an interview with ANI had claimed that he is innocent and all allegations against him are false, baseless and motivated by political expediency.

Choksi holds Antiguan citizenship and is the owner of Gitanjali Group, a retail jewellery company. An arrest warrant for Choksi has been issued in connection with the alleged Punjab National Bank fraud case. He was allegedly involved in stock market manipulation in 2013.

Recently Nirav Modi, nephew of Choksi was ordered to be extradited to India from the United Kingdom to face charges of conspiring to defraud PNB of more than a billion dollars, a UK judge ruled.

Bail Granted To TV Anchor Varun Hiremath in Rape Case by Delhi Highcourt

Varun Hiremath, a TV anchor, was granted anticipatory bail by the Delhi High Court on Thursday in connection with a rape case against him. (State vs. Varun Hiremath) . The trial court had rejected the anticipatory bail plea, stating that the parties’ prior relationship was irrelevant under Sections 53A and 114A of the Indian Evidence Act.
